Purchases - Payment Info

MODERNCRE8VE, Inc. bills you through an online billing account for purchases of products and/or services. You agree to pay MODERNCRE8VE, Inc. all charges at the prices then in effect for the products you or other persons using your billing account may purchase, and you authorize MODERNCRE8VE, Inc. to charge your chosen payment provider for any such purchases. You agree to make payment using that selected payment method. MODERNCRE8VE, Inc. reserves the right to correct any errors or mistakes in pricing that it makes even if it has already requested or received payment. Sales tax will be added to the sales price of purchases as deemed required by MODERNCRE8VE, Inc.. MODERNCRE8VE, Inc. may change prices at any time. All payments shall be in U.S. dollars.

CHARGEBACKS

At MODERNCRE8VE, Inc., we take great pride in providing high-quality made-to-order and custom-made products. As such, we have implemented the following policy regarding chargebacks for our orders:

  1. Non-Tolerance of Chargebacks: Once an order has been placed with MODERNCRE8VE, Inc., we will not tolerate or honor any chargebacks,
  2. Understanding Non-Payment: In our business model, rescinding payment after the fabrication process has begun is considered non-payment for the products that are in the production process or finished and awaiting booking of shipping and delivery,
  3. Made-to-Order and Custom-Made Products: All of our products are made-to-order or custom-made, tailored specifically to meet the unique requirements and preferences of our customers. This personalized approach necessitates significant time, effort, and resources from our team,
  4. Commitment to Customer Satisfaction: We strive to ensure that all our customers are fully satisfied with their orders. Our dedicated team is available to address any concerns or issues that may arise during the ordering and fabrication process,
  5. Transparent Communication: We encourage our customers to communicate openly and promptly with us regarding any questions, changes, or concerns they may have about their order. Our goal is to provide exceptional customer service and resolve any issues in a mutually satisfactory manner,
  6. Resolution of Disputes: In the event of a dispute or disagreement, we encourage customers to reach out to our customer support team at support@moderncre8ve.com, or call us at 216-502-0755. We will make every effort to address and resolve any concerns promptly and fairly.

By placing an order with MODERNCRE8VE, Inc., you acknowledge and agree to abide by this chargeback policy. Please note that this policy is subject to change at any time without prior notice.

Description of Service

Custom and Made-to-Order Furniture - All custom and spec dimensions, edge details, metalwork, and finishes are listed on the invoice for each piece being ordered. Please let us know promptly if you notice any discrepancies when reviewing your invoice / order so modifications can be made prior to your item(s) entering the fabrication process. 

MODERNCRE8VE Product Guarantee

Care Instructions come with each order, and are on our website. When cared for properly, you can expect our handcrafted hardwood furniture to last for many years, truly heirloom pieces! 

Moderncre8ve Inc. guarantees all furniture and products for the first two years after sale, and will repair or replace items if issues occur and proper care conditions were kept as we indicate in our Care Instructions. We craft our furniture using solid hardwoods and as such, there is always a small chance of checking. Checking can occur as the wood expands and contracts with considerable changes in humidity, which is out of our control and not covered in our guarantee. Additionally, we will not replace items damaged by the user or if proper care instructions for the product were not followed, and our guarantee does not extend to cover damage caused by improper use of our products. All issues regarding repair or replacement will need to be reviewed and diagnosed prior to any initiation of repair or replacement.

When choosing hand made hardwood furniture, you are choosing quality and natural beauty over perfection. That is to say, natural wood has tonal streaking, grain irregularity, knots, whorls, textural variances and sometimes a bit of past life evidence (like the bullet fragment we recently discovered embedded in one of our coffee table top slabs!). All of these things fall under the blanket definition of "inclusions", and while the photos of our furniture on our site are very representative of what you're purchasing, each and every piece is different due to these inclusions. We will never send out a finished piece if these naturally occurring inclusions compromise the structural integrity, aesthetic, or lifespan of the furniture. Please understand that if your piece has any of these characteristics that lend to its unique beauty, this does not render it defective or damaged in any way.

Shipping & Delivery

All information in regard to Shipping, taking Delivery, and Buyer Responsibilities can be viewed under our Shipping Policy & Customer Responsibilities, and are binding within this Terms of Service.

Lead times are given at the time of ordering, and vary depending on production volume in the shop at the time the order is placed, complexity involved in the crafting of the piece, and logistics of delivery and shipping availability. Typically, non-custom orders have a 8-10 week lead time; custom orders run 12-16 weeks on lead time (both including delivery scheduling). Please understand that we make every effort to fulfill your order within the stated timeframe. In the event that your lead time needs to be extended more than 1 week beyond the initial final date, we will be in touch to convey this.

    Order Cancellations 

    As all of our items are made-to-order or custom built, the piece(s) is/are not returnable, and cannot be cancelled once fabrication has begun. Should you desire to cancel or modify an order, it is important that you contact us as soon as possible, as we may be able to cancel or make modifications as long as the production process hasn’t begun. In the event you are unhappy with a custom order, please contact us within 72 hours so that we can work with you to resolve any issues.  

    Damaged Product

    If you receive a piece of furniture that is damaged upon arrival, you must note on the BOL (Bill of Lading) at time of delivery. If damage is noted at the time of delivery, the item should be refused and sent back with your Delivery Team. The customer is not responsible for shipping charges for the return of damaged items or replacements sent in this instance.

    Because each of our deliveries includes in-home delivery and assembly, any damage noticed after the Carrier leaves is the Customer's responsibility. In this extremely rare instance, Customers must report damage within 72 hours, and include pictures in your email to MODERNCRE8VE reporting damaged items. Depending on the damage we’ll coordinate the necessary repair or replacement, and convey pricing prior to any return coordination. 

    Force Majeure

    MODERNCRE8VE Inc. shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions, epidemic / pandemic or other acts of nature. 

    Limitation of Liability

    The Client acknowledges and agrees that MODERNCRE8VE Inc. will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
